What is this website legal notices template?

The basics: Otherwise known as ‘website disclaimers’, this is a template document for publishing important warnings, statements or notices on a website that the publishing party intends to have a binding legal effect on its website visitors and (potential or existing) customers.

How do I use this website legal notices template? Similarly to email disclaimers, website disclaimers must be clearly visible and prominent in order to be considered enforceable. You should not use this template for website legal notices to execute a contract with another party to sell your goods or services - for those sales, separate terms and conditions should be used:

What information does this website legal notices template include?

Rules for website use: This website legal notices template is similar to an acceptable use policy, in that the content dictates how website visitors and/or customers (whether guests or registered, if applicable) can use the website (or platform, if applicable), and what the company can exclude liability for in relation to that use and access. For example, the website may contain information about financial matters, but if the company is not a regulated financial advisor, it will want to disclaim liability for reliance on that information by a user, by saying “in giving you access to this information through this website, we do not give financial advice”.

Interaction with third party sites: This website legal notices template also disclaims liability for third party sites that are linked to through the website and redirect users to the terms or privacy notices etc of that third party.

Other assumptions: This website legal notices template assumes that the company is incorporated in, and the website is aimed at customers in the UK, and that English law applies.

Don’t forget about data protection: to comply with data protection laws in the UK, you may also need to include other documents on your website:

  1. Website privacy notice - it is a strict requirement of UK data protection laws to provide a privacy notice to individuals when you collect (or process) personal data about them. You are very likely to collect personal data about website visitors - whether that’s through your online shop, via a contact form on your website or through tracking technologies such as cookies. It’s therefore crucial that a privacy notice is provided to website visitors, so they know how their personal data is being used.
  2. Cookies notice - almost every website will use cookies in order to function and perform to their full potential. Data protection laws require you to tell individuals about the cookie on your website and how they affect website visitors.
